Terms of Service

1. Who we are & what this covers

These Terms of Service ("Terms") govern your use of the Hexink website, web application, and any related services (together, the "Service") provided by the operator named in the Imprint ("we", "us"). By creating an account or otherwise using the Service, you ("you") agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

Hexink is a chemistry-drawing tool. We provide it on an "as-is" basis and continue to evolve it: features may be added, changed, or retired with reasonable notice. The Service is intended for educational, research, and general creative use; it is not a medical device, a regulatory submission tool, or a substitute for professional chemistry, safety, or legal advice.

3. Accounts

You may use parts of the Service anonymously. To unlock account features (cloud library, paid tiers) you must register with accurate information and keep your sign-in credentials confidential. You are responsible for activity on your account. You must be at least 16 years old, or the minimum age of digital consent in your country, whichever is higher. We may suspend or terminate accounts that violate these Terms or that we reasonably believe were created on behalf of someone underage.

4. Your content

You retain all rights in the molecules, drawings, and other content you create using the Service ("Your Content"). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, transmit, render, and back up Your Content solely as needed to operate the Service for you (for example: storing a drawing so you can re-open it on another device, or generating a shareable link you explicitly request). We do not claim ownership and we do not train machine-learning models on Your Content.

5. Acceptable use

You agree not to use the Service to: (a) violate any applicable law or third-party right; (b) plan, depict, or facilitate the synthesis of chemical, biological, or nuclear weapons, explosives, or controlled substances in jurisdictions where doing so is illegal; (c) upload malware, attempt to gain unauthorised access to the Service or other accounts, or probe, scan, or test the vulnerability of any system without our written consent; (d) interfere with the Service's normal operation, including by automated scraping outside published API limits, denial-of-service attempts, or excessive load; (e) resell, sublicense, or expose the Service to third parties as a standalone product without our written agreement.

6. Subscriptions & billing

Paid tiers (e.g. Hexink Pro, Hexink Enterprise) are billed in advance on a recurring basis through our payment processor, Stripe. Prices, billing cycles, and trial terms are displayed at the point of sale. You may cancel at any time from your account page; cancellation stops future renewals but does not retroactively refund the current billing period unless required by law.

Right of withdrawal (EU consumers): If you are a consumer resident in the European Union, you may have a statutory 14-day right of withdrawal for distance contracts. By starting to use a paid digital service during this period you may, depending on the specific tier, lose that right pursuant to § 356 (5) BGB — the checkout flow will inform you explicitly when this applies and ask for your consent.

7. Free tier & trials

We may offer free access to all or part of the Service. Free access is provided at our discretion and may be modified or discontinued at any time. Trial periods convert into paid subscriptions automatically at the end of the trial unless cancelled beforehand; you will be notified before the first paid charge.

8. Termination & deletion

You may delete your account at any time from the account page. Deletion permanently removes your stored content and your Stripe customer record, subject to short backup retention windows and any legal obligation to keep invoicing data. We may suspend or terminate your access for material breach of these Terms; we will try to give you reasonable notice unless doing so would harm other users or the Service.

9. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, scientific or chemical correctness, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any computed property (formula, mass, reaction prediction, etc.) is suitable for any specific use. Mandatory statutory consumer warranties remain unaffected.

10. Limitation of liability

To the extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or EUR 100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for intent or gross negligence, injury to life, body or health, or under the German Product Liability Act).

11. Changes to the Service or these Terms

We may update these Terms from time to time. If a change is material we will notify you in-app or by email a reasonable period before it takes effect. Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you may terminate your account before they take effect.

12. Governing law & venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, mandatory consumer-protection provisions of the country of your habitual residence remain unaffected. The exclusive place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is the registered seat of the provider as named in the Imprint.

13. Severability & entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any tier-specific order form, constitute the entire agreement between you and us regarding the Service.
